Definitions:

"Educational institution" refers to an entity that acts as an intermediary between you as a user and ActiveClass. Any entity that creates or transfers in any way user account information to ActiveClass for any purpose beyond that entity's own personal and singular use shall be considered an educational institution.

This Privacy Policy describes ActiveClass Inc.'s (“ActiveClass”, “us” or “we”) practices regarding the personal information that may be collected from users of this website (“Website”), as well as ActiveClass iOS and Android applications to the extent made available (“Apps”), including any products or services that may be offered on the Website and Apps (“Services”). The Website, Apps and Services are collectively the platform ("Platform").

By accessing or using the Website, or App or otherwise registering to use the Platform, you expressly consent to the collection and processing of your personal information in accordance with this Privacy Policy. This Privacy Policy provides default provisions regarding your usage of ActiveClass Services. However, provisions in contracts between ActiveClass and you or ActiveClass and third parties through which you have ActiveClass access shall take priority over the provisions enumerated here. Agreements between your Educational Institution and ActiveClass shall have the highest priority; please contact your Educational Institution for any such provisions. Please print a copy of this Privacy Policy for your reference.

Amendments to the Privacy Policy:

ActiveClass may modify or amend this Privacy Policy at any time. All changes will be effective immediately upon their posting on this Website. Material changes will be posted conspicuously on this Website. By accessing the Website, Apps, Services, or Platform following posting of changes to the Privacy Policy, you agree to all such changes.

IMPORTANT NOTICE FOR Educational Institution USERS:

If you are receiving access to the ActiveClass Platform through your educational institution, please note that this Privacy Policy only applies to ActiveClass' privacy practices and does not govern your educational institutions collection, use, or disclosure of personal information that is collected through the Platform. We are not responsible for the collection, use, or disclosure of your personal information by your educational institution.

We share the data that we collect from you with your educational institution. In addition we may use and share your data as directed by your educational institution. If you have any questions regarding what personal information is used and shared by your educational institution, please refer to your educational institution’s terms of service and privacy policy.ActiveClass is acting as an agent on behalf of your educational institution and will retain the personal information we process on behalf of the educational institutions for as long as requested by those institutions.

Any parties which have a legal right to access educational records beyond that available through normal use of ActiveClass must access those records through the appropriate educational institution. ActiveClass does not process requests for educational records; educational institutions assume responsibility for all such requests.

DATA PROVIDED TO US:

You may visit this Website and download our App (as made available) without registering with us. However, if you choose to register with us to use the Platform, you will be required to provide us with personally identifiable information.

We collect information from you when you create an account to log in to our Platform. To register with us, you will be required to provide your first and last name, gender, e-mail and mailing addresses, birth date, username and password. If your account is set up for you by your educational institution, your educational institution will provide us with this information.

When you participate in one of our surveys, we may collect additional profile information, which will be identified in the applicable survey terms. We may add this information to your profile and use and share it along with your other personal information as contemplated in this Privacy Policy.

We also collect any data related to any content that you may upload and share with us as your User Content as set forth in the Terms and Conditions of Service. Your User Content is content that you voluntarily provide to us as part of your use of the Platform, such as documents, photos, or videos that you post (which may include incorporated metadata, as defined below) or messages that you send or receive to other users on the Platform.

When you submit or share content or other information on the Platform, that content and information may be accessible to or shared with other users on the Platform, depending on your account settings and the policies of the group(s) to which you belong or your educational institution as applicable. You are not required to post any information. By choosing to submit or share content or other information, you are consenting to this information being shared.

Please note, if you choose to make any User Content available to third party Platform users, such User Content will be shared to such other users and will be connected to your user name. If you do not want User Content connected to your user name, do not upload it to the Platform.

DATA COLLECTED VIA TECHNOLOGY:

To make our Platform more useful to you, we (or our third party service providers on our behalf) automatically collect information from you when you access the Platform. This information consists of browser type, operating system, Internet Protocol (IP) addresses, domain name from which you visit, and/or a date/time stamp for your visit. Like most Internet services, we automatically gather this data and store it in log files each time you visit our Platform. We use this information to monitor how our Platform is used and compliance with our Terms and Conditions of Service.

We also use cookies when you visit our Website. “Cookies” are small pieces of information that a website sends to your computer’s hard drive while you are viewing a website. We may use both session cookies (which expire once you close your web browser) and persistent cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience on our Platform. We may also use third party cookies for various third party vendors and services that we use to help maintain the Website, as further set forth below.

Our Website and communications from our Platform may also have web beacons. “Web beacons” are digital images we use to log information on our Platform and in our e-mails that tells ActiveClass what information your browser loads and what e-mail messages you accessed. We use web beacons to manage cookies, count visits, and to learn what works in reaching our audience and what does not. We also use web beacons to tell if you open or act on our e-mails.

Analytics. Like many websites, we use Google Analytics to collect information about your use of our Site. This information consists of information that your web browser automatically sends to Google, such as the web address of the page that you visit and your IP address. Google may also set cookies or read preexisting cookies. This information is stored on Google´s servers. Google uses this information to provide use with reports about traffic to our Site and your visit to our Site (such as the domain from which you access the internet, the web address of the website from which you linked to our site, the time and date of your visit the web pages that you view and click through). We will use this data to improve our Site structure and content.

You may opt-out of our use of Google Analytics by visiting the Google Analytics opt-out page and installing the Google Analytics browser add-on, currently made available by Google at https://tools.google.com/dlpage/gaoptout.

Metadata. Documents, photos or videos and other postings also typically have internal 'metadata' that is automatically included with that posting, such as time, date, and place the document was created. Metadata may be used as part of an ongoing effort to enhance the Website as well as the services provided.

Device ID’s. Device ID’s are collected and associated with user accounts to send push notifications about activity on ActiveClass, such as posts, due dates, and messages.

Geolocation. ActiveClass uses geolocation to help provide authentication that you are the individual accessing your account and not a third party. We do not use geolocation for any other purpose at this time.

Do Not Track: Our Website automatically uses cookies and therefore does not respond to Do Not Track (DNT) signals. ActiveClass does not do anything to bypass these signals, nor do we do anything to track these signals.

At this time, ActiveClass does not track its customers over time and across third party websites to provide targeted advertising and

Third Party Data Collection:

ActiveClass uses third party service providers like Intercom to provide certain Services to you in connection with the Platform. By using the Platform you may disclose personally identifiable information to such third party service providers for the sole purpose of the provision of services to you. By using this Platform you consent, authorize, and acknowledge this sharing of personally identifiable information to third party service providers.

Third parties can collect personally identifiable information from ActiveClass' Website if you provide it to them directly or in the case of educational institutions if they request access to the data.

USE OF YOUR DATA:

In addition to the specific uses set forth above, ActiveClass will use your personal information and the information we collect from and about you and your use of the Website, App, or any part of the Platform to provide you with the Services and otherwise operate, maintain, and improve the Platform, including in the following ways: to create and maintain your account; to identify you as a user in our Platform and as a member of groups within the Platform; to personalize and improve your experience, to send you administrative communications; to respond to your comments or inquiries; to send you surveys and promotional communications about our Platform; to protect, investigate, and deter against fraudulent, unauthorized, or illegal activity; or to solicit your feedback.

As contemplated above, ActiveClass may, from time to time, send you emails. These emails may be administrative in nature regarding your account or your use of the Platform or may otherwise be requested from your educational institution. You may not opt out of these emails as these are necessary for us to administer and provide the Platform. Emails from ActiveClass may also be related to your activities on the Platform, including messages from other users or groups using ActiveClass. You may change your settings with respect to sending or receiving communications from other ActiveClass users from within your account. Emails from ActiveClass may also contain marketing material related to our Platform or additional products or services of ActiveClass or offers, information or events from others that we think may be of interest to you. You may opt out of these emails by changing your account settings.

DISCLOSURE OF YOUR PERSONAL INFORMATION TO OTHERS:

In addition to the disclosures contemplated above, ActiveClass will share your personal information with third parties as follows:

Groups. If you follow an organization or join a group within the ActiveClass Platform, your personal information may be shared with that organization or group (including posts, videos, documents, events, and other information that you elect to share with that organization or group).

Third Party Users. If you elect to communication with another ActiveClass user via the Platform or upload User Content, your personal information may be shared with that individual in connection your communications and User Content.

Third Party Service Providers. We will share your personal information with our third party service providers that we have engaged to help use deliver, operate, and maintain the Platform. ActiveClass has a policy requiring these providers to maintain information confidentiality. These third party service providers consist of Google Apps for Education (including Gmail, Hangouts, Calendar, and Drive), Intercom, New Relic, our cloud service provider, and our plagiarism detection software. We may also share data with our service providers who provide marketing or other services for us.

Other Disclosures. ActiveClass may also disclose information about you if it believes such disclosure is necessary to (a) comply with laws or to respond to lawful requests and legal process; or (b) protect or defend the rights, safety, or property of ActiveClass, users of the Platform, or any person, including to enforce our agreements, policies, and terms of use; or (c) in an emergency to protect the personal safety of any person. We may also disclose your information to any third party in the course of any merger, acquisition, reorganization, or sale of substantially all our assets, provided any successor will continue to be bound by the terms of this Privacy Policy.

Retention. ActiveClass retains your information for as long as needed to provide Services and as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

THIRD PARTY PLATFORMS:

We may allow you to connect and share information from the Platform with certain social networking platforms (“Third Party Platforms”) (e.g., a Facebook application). By choosing to use these Third Party Platforms in connection with your use of the Platform, you allow ActiveClass to share your information with the Third Party Platform. For example, you might use publish ActiveClass related notices on your Facebook wall

You can also access certain features of our Platform using Third Party Platforms. These Third Party Platforms will authenticate your identity and provide you the option to share certain personal information with us such as your name, email address, and other personal information.

We do not control the privacy practices of the Third Party Platforms and sign-in services you choose to use and this privacy policy does not cover their practices. You should visit the privacy policies of any Third Party Platform or sign-in service you choose to use to understand their practices.

CHANGES TO PERSONAL INFORMATION:

You may change certain parts of your personal information in your account by editing your profile within the Website or App. You can also request changes or deletions to your information by e-mailing us at the e-mail address set forth below. We will respond to your emailed request, when permitted by law, within 30 days. We may be unable to delete information that resides in our archives.

Not all information in your account may be edited, deleted or otherwise changed. If your account was assigned to you by an educational institution, then you may change your profile picture, name (upon request), and access level for courses (student or administrator). If your account is a self-registered account then you may change your username, password, first name, last name, profile picture, and access level.

SECURITY OF YOUR PERSONAL INFORMATION:

ActiveClass takes reasonable steps to help protect your personal information in an effort to prevent unauthorized access, use, or disclosure of your personal information. We limit access to personally identifiable information about you to our employees and third-party service providers whom we reasonably believe need to have access to your information to provide you with the information or services you request from ActiveClass.N

We use industry standards, such as Transport Layer Security (“TLS”) technology, to help safeguard your data against unauthorized access, use, or disclosure during transmission. In certain areas, the information passed between your browser and our system is encrypted with TLS technology to create a protected connection between you and our Website to ensure confidentiality. In the event that a breach into our security systems occurs and there is a possibility that an unauthorized person acquires your personal information, ActiveClass will notify you of such a breach solely to the extent required under applicable law.

Despite these measures, ActiveClass cannot fully eliminate security risks associated with personal information and use of the Internet carries inherent risks. No method of transmission over the Internet or method of electronic storage is 100% secure. Therefore, we cannot guarantee your security or the security of your information or data. Data Processing

All data sent to ActiveClass is processed in the geographic area in which it originated. This means for data which originates in EU, that data will remain in Europe. For data that originates in the United States, that data will also be stored and processed in the United States. Residents of the EU and Switzerland have the right to access the personal information that ActiveClass maintains, and in some cases, may have the right to correct or amend information that is inaccurate or has been processed in violation of Privacy Shield, to the extent allowed by law. To exercise this right, contact us at .ActiveClass is in the process of meeting compliance with the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework (“Privacy Shield”) as set forth by the U.S. Department of Commerce. ActiveClass does not presently rely on Privacy Shield as a valid transfer mechanism between the United States and the European Union (“EU”) and Switzerland, we will continue to invest in achieving the use of this framework.

ACCESS BY CHILDREN:

This Website is generally not directed toward children under 13 years of age and ActiveClass does not knowingly collect or use information from children under 18 through this Website. ActiveClass uses industry standards to ensure that children under 13 are flagged as such when using ActiveClass, to ensure compliance with applicable law.

As an exception to this rule, children under 13 may use ActiveClass if, and only if, they do so through an educational institution. Educational institutions are required to obtain and maintain records of parental consent to use ActiveClass for children under the age of 13.
